Data Processing and Confidentiality Agreement

1. General provisions

1. This Agreement defines the procedure for processing and protecting the information of Klimatek Engineering ООО (INN/KPP 7716766039/772201001, OGRN 1147746097476) about an individual (hereinafter referred to as the User) using the services of the website http://www.climatech-engineering.ru (hereinafter referred to as the Site) and its services.
2. The purpose of this Agreement is to ensure proper protection of user information, including their personal data, from unauthorized access and disclosure.
3. The relations related to the collection, storage, dissemination and protection of information about the users of the Site are regulated by this Agreement, other official documents of the Contractor and the current legislation of the Russian Federation.
4. The current version of the Agreement, which is a public document, is available to any Internet user. The Contractor has the right to make changes to this Agreement. When making changes, the Contractor notifies users by posting the new version of the Agreement on the Website at the permanent address http://climatech-engineering.ru/privacy-policy
5. By using the Website, the User expresses his consent to the terms of these Rules and agrees to the automated, as well as without the use of automation tools, processing of his personal data, namely, performing the actions provided for in paragraph 3 of Article 3 of Federal Law No. 152-FZ of 27.07.2006.
6. If the User does not agree with the terms of this Agreement, the use of the Site and its services must be immediately terminated.

2. Subject of the agreement

1. The User provides the Contractor with information about personal data and agrees to its gratuitous use by the Contractor for the purposes and to the extent provided for in this Agreement.
2. The purpose of personal data processing is to provide the User with information about the Contractor, about the services and promotions of the Contractor, its business partners and affiliated persons. In particular, the use of such User data to conduct promotional newsletters and campaigns in any form not prohibited by applicable law.
3. The Contractor has the right to use the information provided by the User for other purposes not specified in clause 2.2 of this Agreement, based on the needs of conducting its financial and economic activities and within the framework of current Legislation.

3. Terms of use of the Website

1. By providing services for the use of the Site and its services (hereinafter referred to as the Site Services), the Contractor, acting reasonably and in good faith, believes that the User:

• has all the necessary rights that allow him to register and use this Site;
• provides reliable information about himself to the extent necessary to use the Site’s Services;
• is aware that the information on the Site posted by the User about himself may become available to other Users of the Site and Internet users, may be copied and distributed by such users;
• is aware that some types of information transmitted by him to other Users cannot be deleted by the User himself;
• is familiar with these Rules, expresses its agreement with them and assumes the rights and obligations specified in them.

2. The Contractor does not verify the accuracy of the information received (collected) about users, except in cases where such verification is necessary in order for the Contractor to fulfill its obligations to the user.

4. Data processing

1. The User provides and authorizes to perform the actions stipulated in the Agreement with the following personal data:

• Last name, first name, patronymic of the User;
• User’s email address;
• The User’s phone number;
• User’s residential address;

2. By accepting the terms of this agreement, the User provides consent to the processing of his personal data to the Contractor, its affiliates, representatives, employees, business partners, contractors.
3. The processing of personal data means the following list of actions with personal data:

• collection
• recording
• systematization
• accumulation
• storage
• refinement (updating, modification)
• extraction
• use
• transfer (distribution)
• depersonalization
• deletion
• destruction of personal data.

4. This consent to the processing of personal data is valid indefinitely, but may be revoked by the personal data subject on the basis of a personal written statement sent to the Contractor’s legal address by registered mail with delivery notification or delivered on purpose.
5. By accepting the terms of this agreement, the User agrees to receive promotional newsletters in the format of SMS messages, calls, e-mail newsletters and in other ways not prohibited by applicable law.
6. The Contractor undertakes to use the User’s personal data obtained under this Agreement (or in any other way not prohibited) in accordance with the requirements of the legislation on the protection of personal data of the Russian Federation, in particular in accordance with the requirements of Federal Law No. 152-FZ dated 27.07.2006 “On Personal Data” as amended at the time of processing such personal data.
7. The User has the right:
   1. to require the Contractor to clarify his personal data, block it, or destroy it.
   2. on the basis of a request, receive information from the Contractor regarding the processing of his personal data.

5. User requests

1. The User has the right to send his requests to the Contractor, including requests regarding the use of his personal data, in writing to the address: 105005, Moscow, nab. Akademika Tupoleva 15, k2 “Tupolev Plaza Business Center”, or in the form of an electronic document signed with a qualified electronic signature in accordance with the Legislation of the Russian Federation, to the following email address: info@climatech-engineering.ru
2. The Contractor undertakes to review the User’s request and respond to it within 30 calendar days from the date of receipt of the request.
3. All correspondence received by the Contractor from Users (written or electronic requests) is classified as restricted information and is not disclosed without the written consent of the User. Personal data and other information about the User who sent the request may not be used without the User’s express consent, except in cases of responding to the subject of the request received or in cases expressly provided for by law.
